Arrested After a Car Crash? Jail Is One Case. The Injury Claim Is Another.

If you are reading this, someone you love is probably sitting in a jail or a hospital — or both.

That is more common than people think. A crash on I-15, a DUI stop that started with a fender-bender, a hit-and-run that turns into an injury call. Police show up. Somebody goes to booking. Somebody else goes to the ER. Families call us about the bail piece and only later realize the medical bills and insurance fight did not pause because of the arrest.

First things first: get them out, then sort the rest

If someone is still in custody, that is the emergency.

Once they are out, the crash file is still open. Bail does not pay the ambulance. Bail does not talk to the insurance adjuster. Bail does not stop a two-year deadline on an injury lawsuit.

The criminal case and the injury case are not the same stack of papers

This is the part that trips people up at 2 a.m.

The criminal case is the State against the driver. Jail, fines, license, court dates. We help with the release so they can make those dates.

The injury case is about medical bills, lost work, pain, and whose insurance pays. It can belong to the passenger who got hurt. It can belong to the other driver. It can belong to a family after a fatal wreck. It can even matter when your loved one was the one arrested, if someone else caused part of the harm or if they were injured too.

You do not have to wait for the criminal case to finish before an injury claim starts. In fact, waiting is how evidence walks off the tow yard and deadlines sneak up.

A conviction can help a civil case. A dismissed charge does not automatically kill one. Different courts. Different proof. Different calendars.

When this comes up for San Diego families

We hear these versions all the time:

  • A weekend trip to Las Vegas. A crash near the Strip or on the drive home. Someone is booked in Clark County. Someone else is in a Nevada hospital.
  • A DUI with injuries. The booking is in San Diego County, but the injuries are serious and the insurance company is already calling.
  • A hit-and-run. One person is in jail. The other person is trying to find out who pays for surgery.
  • A work van or rideshare wreck where the employer, the other driver, and the criminal charge are all pointing at each other.

What to do in the first 48 hours

  1. Post bond if they are eligible. Sitting in jail makes every other task harder.
  2. Get the booking info and the crash report number. You will need both.
  3. Take photos of injuries and vehicles as soon as it is safe.
  4. Do not give a recorded statement to an insurance company while someone is still foggy from the crash or the jail.
  5. Keep every ER bracelet, bill, and work-excuse note.
  6. Write down witnesses before numbers get lost.
  7. If the wreck was in Las Vegas or elsewhere in Nevada, talk to a Nevada injury lawyer before you accept a quick check.

None of that replaces medical care. If they need a hospital, they go to the hospital. We can still work the bond.

If the wreck was in Las Vegas

Nevada injury claims have their own rules, including a two-year window in many cases to file a lawsuit. DUI crashes can also open the door to extra damages because impaired driving is treated as a serious disregard for other people on the road.

That is not something to DIY from a San Diego kitchen table while you are also trying to make a court date.

A Las Vegas personal injury attorney who does this all day can look at the police report, the hospital records, and the insurance policies and tell you if there is a claim worth making.

If your loved one was the one arrested

You can still be careful without making the injury claim worse.

Do not post crash videos. Do not argue fault in the comments. Do not sign a medical-records release just because an adjuster sounded friendly. Go to the criminal court dates. Call us if anything about the bond or the next hearing is confusing.

And if they were hurt in the same wreck — airbag, broken wrist, night in the ER before booking — say that out loud to an injury lawyer. Jail does not erase an injury.
