It is not binding until a completed application has been underwritten, the indemnitor(s) have been qualified, any required collateral has been accepted, and the appointed surety has approved the bond. How California Bail Bond Premiums Work
Premium rates for California bail bonds are filed with and regulated by the California Department of Insurance. The premium is a percentage of the full bail amount set by the court (most commonly 10%). Once the bond is posted and accepted, that premium is fully earned. It is generally non-refundable if charges are dropped, the case is dismissed, or the defendant is later released without a conviction. A limited statutory exception applies if the defendant is surrendered under California Code of Regulations, Title 10, § 2090; any return of premium in that situation is reduced by allowable administrative costs.
Reduced Rates and Eligibility Discounts
Reduced rates — including those for military members, veterans, union members, homeowners, seniors/AARP, attorney-referred clients, and other categories listed on the applicable filed schedule — are available only when the surety’s filed rates permit them and only when the applicant provides timely, acceptable documentation of eligibility. A discount that is not on the filed schedule cannot be given.
Payment Plans and Financing Terms
Payment plans, 0% interest financing (where offered), low-down or no-money-down arrangements, and similar options are not automatic. Terms, down payment, payment dates, and any collateral requirements are set out in a written agreement that must be signed before the bond is posted. Not every applicant will qualify. There are no hidden add-on fees beyond the filed premium and any actual, necessary, and reasonable expenses permitted by California law.
